3. Recruitment Services

3.1 Scope of Services

Castle & Co. Search provides executive and senior-level recruitment services for clients within the Retail and Sales sectors. Our services include, but are not limited to: candidate search and selection, interview facilitation, and placement support.

3.2 Client Engagements

All recruitment assignments undertaken by Castle & Co. Search are governed by a separate Client Services Agreement, which sets out the specific terms, fees, and conditions applicable to that engagement. These Terms apply in addition to, and do not replace, any such agreement.

3.3 Fees

Our fees are charged as a percentage of the candidate's agreed first-year gross remuneration, with the applicable rate determined by the level of the appointment:

•       Senior Manager / Department Head: 15% to 18%

•       Director / Regional Director: 18% to 22%

•       VP / C-Suite / Managing Director: 22% to 25%

For contingency assignments, the fee is charged at the lower end of the relevant band. For retained or exclusive assignments, the fee is charged towards the upper end of the relevant band. Retained and exclusive fees are payable in agreed instalments.

Fees are subject to VAT at the prevailing rate. Invoices are due within 30 days of the date of issue unless otherwise agreed in writing.

3.4 Guarantee Period

We offer a 12-week replacement guarantee from the candidate’s start date. If a placed candidate leaves or is dismissed within this period (other than due to redundancy or material change to the role), we will conduct one replacement search at no additional fee. This guarantee applies only where our invoice has been paid in full and the role has not materially changed.

3.5 No Guarantee of Outcome

While we work diligently on every assignment, we cannot guarantee that a suitable candidate will be identified or placed within any specific timeframe. Placement outcomes depend on market conditions, candidate availability, and client decisions beyond our control.

3.6 Candidate Introduction

Where a candidate is introduced to a client by Castle & Co. Search and is subsequently engaged, whether directly or through a third party, within 12 months of introduction, our full fee shall be payable.

4. Candidate Information

4.1 Registering as a Candidate

If you submit your details to Castle & Co. Search as a prospective candidate, you confirm that the information you provide is accurate and up-to-date. You authorise us to present your details to relevant client organisations in connection with specific roles for which you may be suitable.

4.2 No Employment Relationship

Registering with Castle & Co. Search does not create any obligation on our part to find you employment, nor does it create an employment relationship between us.

4.3 Confidentiality

We treat all candidate information with the utmost discretion. Your details will not be shared with any client without your prior knowledge and agreement.

5. Data Protection and Privacy

5.1 Data Controller

Castle & Co. Search is the data controller for personal information collected through this website and in the course of our services. We are committed to handling all personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

5.2 What We Collect

We may collect and process the following categories of personal data:

•       Name, contact details, andprofessional background (candidates and clients)

•       CV and career history information (candidates)

•       Correspondence and communication records

•       Website usage data (via cookies and analytics)

5.3 How We Use Your Data

We use personal data to:

•       Provide and improve our recruitment services

•       Communicate with clients andcandidates

•       Comply with legal and regulatory obligations

5.4 Retention

6.2 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

6.3 Our total aggregate liability to any party in connection with our services shall not exceed the fees paid or payable by that party in the 12 months preceding the claim.

7. Indemnity

You agree to indemnify and hold harmless Castle & Co. Search, its directors, employees, and agents from and against any claims, losses, damages, and expenses (including reasonable legal costs) arising from your breach of these Terms or misuse of our website or services.

8. Variations

We reserve the right to update these Terms at any time. The current version will always be posted on our website. Continued use of our website or services following any update constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from them shall be subjectt o the exclusive jurisdiction of the courts of England and Wales.
